ACCEPTANCE OF TERMS OF USE

Eldemiry LLC. (“ Eldemiry ” ” we ” or “ us ” or “ our ”) owns and operates the website of eldemiry.com. By using eldemiry.com to signing up for an account and/or completing a purchase on the Site, you agree to these Terms of Use (defined below) and any modifications or additional terms we may add in the future. You also agree to our Privacy Statement and acknowledge that you will regularly visit the Terms of Use (defined below) to familiarize yourself with any updates.

These Terms of Use are organized as follows:

First, About the Site:

The site is a platform to provide various offers for products that some people or customers may need.

Second, The method of contracting and purchasing from our website:

Regarding the customer purchasing any product from our website, this transaction is contracted through a Salam contract.

Any transaction that takes place through our website to purchase a product or a group of products is considered a Salam contract.

Since we do not have any products during the process of promoting and selling the products, but we get the cost of the product first from the customer, and then we directly buy the product that the customer requested from the supplier in the same quantity chosen by the customer and with the same product specifications displayed on our website, then we send and ship the product directly From the supplier to the customer on the specified date that the customer will accept during the purchase process on our site. For all of that, all transactions that take place through our site are considered Salam contracts, and the Salam contract is the sale of something described in the trust that is not present now, provided that the demander of the product who is the customer pays the cost of the product immediately.

Third, Limitation of Our Liability for Our Customers:

We are committed to sending the products to the customers at the specified dates that the customer will choose during the purchase process, with the product being sent to the customer in the same quantity that the customer requested, and with the same specifications that the customer viewed on our website during the purchase process.

Fourth, About customs and taxes of the country you live in:

Be aware that when the product arrives in your country, the country in which you live may ask you for additional costs on this product, such as customs and taxes. And you agree to pay these additional costs for the country in which you live without holding our website responsible for that. Knowing also we bear the cost of the value-added tax (VAT) for customers whose delivery/shipping addresses will be in the European Union countries.

Fifth, About Refunds:

Refunds are approved in the following cases

1- Incorrect product.
it can be like a Product with the wrong attributes. it can be like you received a single-layer rice cooker, but you ordered a double-layer rice cooker.

2- Damaged Products.
it can be like a broken product.

3- Products Out of Stock.
We offer a full refund if the product is out of stock. We will notify you and make the refund immediately.

4- Products Unable to Ship.
We offer a full refund if the product can not be shipped. We will notify you in time and make the refund.

5- We agree to refund the money if the product arrives to the customer after the maximum delivery date and the delay was due to us. But if the delay is due to customs, the presence of official holidays in your country, or because you were not present at the shipping address on the delivery date, then you must accept a late delivery date because the delay was not because of us. Also, if the delay is due to reasons beyond our control, such as (epidemic situation, international situation, strike, war, earthquake, flood, virus, storm, heavy snow, or customs inspection.), then you must accept a late delivery date because the delay was not because of us.

Refunds, returns, and disputes are not approved in the following cases

1- The customer does not like the product.
If you don’t like the product, don’t buy it from the beginning.

2- The product doesn’t match the listing description due to inaccurate measurement.
Many manual measurements have some errors and this is a common mistake in most online and non-electronic stores. So, allow a 1-3cm manual measurement error.

3- The product smells unusual.
If the smell of the product is unusual, you can put it in the open air for 3 or 4 hours.

4- Shipping delay because of any of these reasons:
(epidemic situation, international situation, strike, war, earthquake, flood, virus, storm, heavy snow, or customs inspection.).

5- Purchase cancellation requests after payment:
We do not accept requests to cancel purchases after payment, because as soon as the customer pays us the value of the order, we process it so that it is shipped to the customer as quickly as possible. So if you are not sure you want to buy the product, do not buy it from the beginning.

How to request a refund if the product is incorrect or damaged

Within 5 days from the date of receiving the product, the customer can send us by using fit subject like (about my refund request) on this email support@eldemiry.com from the same email address that he used in the purchase form, and inform us in writing of the reason for the refund request, then give the purchase/order number in the message and the name of the product, along with sending a picture or pictures proving that the product is damaged or incorrect, and we will do a refund for the customer within 5 working days but the money will appear in the customer bank/card account after an extra 10 to 15 working days.

Sixth, Dispute Resolution/Arbitration Agreement:

In the case of any dispute between you and Eldemiry, we will work to resolve it amicably, but if we can not resolve it amicably, you agree that the competent courts in the state of New Mexico in the United States will resolve difficult disputes between us even if you reside outside of the state of New Mexico.
